1. General provisions
1.1. The company Connect Online s.r.o. (Company ID: 171 61 398, registered address: Plzeňská 1270/103, Košiře, 150 00, Praha 5, Prague, Czech Republic), hereinafter the Seller, publishes this Public Offer for virtual balance top-up services through the Telegram bot (@gemera_vpn_bot).
1.2. This document is a public offer. By accepting the terms below, an individual tops up their virtual balance in accordance with this Agreement. Payment for the Seller's services constitutes acceptance of the offer and is equivalent to concluding an Agreement on the terms set out herein.
1.3. Please read this public offer carefully. If you disagree with any provision, you should refrain from using the Seller's services.
1.4. Unless the context requires otherwise, the following terms have the meanings set out below:
1.5. Offer means the Seller's public proposal to any individual to enter into an agreement on the existing terms of this Agreement, including all its appendices.
1.6. Buyer means an individual who has entered into an Agreement with the Seller on the terms contained herein.
1.7. Acceptance means the Buyer's full and unconditional acceptance of the Agreement's terms.
1.8. Service means topping up a user's virtual account balance for subsequent purchases of digital services through the Telegram bot (@gemera_vpn_bot).
1.9. Service characteristics means the balance top-up parameters presented in the Telegram bot (@gemera_vpn_bot).
1.10. Order means a virtual balance top-up request placed by the Buyer in the Telegram bot (@gemera_vpn_bot).
1.11. User means an individual who has activated the Telegram bot (@gemera_vpn_bot).
2. Subject of the Agreement
2.1. The Seller provides virtual balance top-up services according to the current price list published in the Telegram bot (@gemera_vpn_bot), and the Buyer pays for and accepts the services under this Agreement.
2.2. This Agreement and its appendices are the Seller's official documents and an integral part of the offer.
3. Placing an Order
3.1. The Buyer places an Order for the Service through the Telegram bot (@gemera_vpn_bot).
3.2. When placing an Order through the Seller's Telegram bot, the Buyer must provide the following registration information: their Telegram account ID.
3.3. The Seller is not responsible for the content or accuracy of information provided by the Buyer when placing an Order.
3.4. The Buyer is responsible for the accuracy of the information provided when placing an Order.
3.5. Payment for an Order independently placed by the Buyer in the Telegram bot constitutes agreement to these terms. The payment date is the date the Agreement is concluded between the Seller and Buyer.
3.6. All information presented in the Telegram bot (@gemera_vpn_bot)is for reference only and may not fully convey accurate information about specific properties and characteristics of the Services. If the Buyer has questions, they should consult the Seller through the available contact channels before placing an Order.
4. Order fulfilment times
4.1. The Order will be fulfilled within 10 minutes after payment by crediting the Buyer's virtual balance.
4.2. The Order is considered fulfilled when funds are credited to the Buyer's virtual balance. A notification will be sent through the Telegram bot (@gemera_vpn_bot).
4.3. If the Buyer provides incorrect contact information, the Seller is not liable for improper fulfilment of the Order.
5. Payment for an Order
5.1. The Buyer pays for the Order by electronic money transfer. Payment is confirmed by the deduction of funds from the Buyer's electronic account.
5.2. Payments are accepted by the following methods:
- bank card;
- SBP (Faster Payments System);
- Steam skins;
- Telegram Stars.
5.3. The minimum virtual balance top-up is 100 roubles.
5.4. Funds in the virtual balance do not expire and may be used at any time to purchase services through the Telegram bot (@gemera_vpn_bot). These funds cannot be withdrawn or refunded; they can only be used within the service.
6. Refunds
6.1. Due to the technical nature of the services and the digital nature of virtual balance top-ups, refunds are made solely at the Seller's discretion on a case-by-case basis.
6.2. If a technical error occurs when topping up the balance, the Buyer may contact support within 3 business days of payment to request consideration of a refund.
6.3. Funds credited to the virtual balance are non-refundable under any circumstances and are not electronic money, savings or a deposit. They may only be spent on services within the Telegram bot (@gemera_vpn_bot); transfer, exchange or withdrawal is not permitted.
6.4. In the event of an erroneous payment, a refund may only be made to the same payment instrument used for the payment, less payment system fees.
6.5. The Seller reserves the right to refuse a refund where there are grounds to believe the request is connected with attempted fraud.
7. Copyright
7.1. All text and graphic materials published in the Telegram bot (@gemera_vpn_bot)are the property of the Seller and/or its partners.
8. Rights, obligations and liability
8.1. The Seller is not responsible for the Buyer's improper use of services through the Telegram bot (@gemera_vpn_bot).
8.2. The Seller may transfer its rights and obligations relating to Order fulfilment to third parties.
8.3. The Seller undertakes to prevent unauthorised access to information and/or its transfer to persons not directly involved in Order fulfilment, and to promptly detect and stop such incidents.
8.4. The Seller is not liable for damage suffered by the User through use of the services, or for losses caused by inability to use them.
8.5. The Seller accepts no liability for lost data, messages or web pages that were not delivered, were deleted or incorrectly redirected due to service failures, telecommunications failures or network infrastructure issues.
8.6. The User agrees to use the services solely for lawful purposes and in accordance with the laws of the country in which they are located.
8.7. Claims concerning improper Order fulfilment are accepted through support by email or Telegram. Requests are processed as promptly as possible.
8.8. The Seller is not responsible for connection unavailability and/or inability to establish a proper connection for reasons beyond its control, including, without limitation, allowlist policies (including in the Russian Federation), traffic blocking or filtering (DPI), restrictions imposed by internet providers, corporate or campus networks, firewalls, or other third-party restrictions. Such circumstances do not constitute a breach of the Services and do not qualify for compensation.
9. Loyalty programme
9.1. The Seller may credit bonus funds to the virtual balance as part of marketing promotions and loyalty programmes.
9.2. Bonus funds may have an expiry date and special conditions of use, which will be communicated when the funds are credited.
9.3. Virtual balance funds, including bonus funds, may only be used to purchase services through the Telegram bot (@gemera_vpn_bot). Funds cannot be withdrawn.
10. Termination of services
10.1. The Seller may restrict the Buyer's access to services if misuse is identified, including:
- Breach of this Agreement
- Attempts to hack or gain unauthorised access to the system
- Actions that may harm the operation of the service
- Use of the service for unlawful activities
11. Force majeure
11.1. A party that fails to perform or improperly performs its obligations under this Agreement is not liable if proper performance was made impossible by circumstances beyond its control (force majeure).
11.2. Force majeure includes wars, floods, fires, earthquakes and other natural disasters, strikes, changes in applicable legislation, third-party provider failures, data transmission difficulties, and equipment or network failures or restrictions.
12. Final provisions
12.1. This Agreement is governed by the laws of the Czech Republic.
12.2. The parties will seek to resolve disputes and disagreements arising from performance of this Agreement through negotiation.
12.3. If a dispute cannot be resolved through negotiation, it shall be submitted to the courts at the Seller's place of registration.
12.4. The Seller reserves the right to amend this Agreement, with mandatory notice to Users through the Telegram bot (@gemera_vpn_bot) at least 7 days before the changes take effect.
12.5. For all matters relating to performance of this Agreement, the Buyer may contact support@gemera-vpn.net.
13. Service level guarantee
13.1. Compensation is granted upon a support request at https://t.me/gemera_app. It is provided only as additional service days and cannot be paid in cash. The operator guarantees connection availability of 98% per month. If the offer is breached, each full day (24 hours) of service downtime is compensated to the User at twice its duration through the virtual balance in the Telegram bot (@gemera_vpn_bot).
13.2. The Seller is not liable for lost data or messages, or pages displayed incorrectly due to network problems (for example, on a T-1 line). To protect Buyers, the Seller may unilaterally restrict the use of certain data and block service to clients. Network speed is a nominal estimate and does not represent actual upload or download speed. Actual speed depends on network configuration, data compression, load and other factors. The Seller does not guarantee timely receipt of data and is not liable for delays or losses.
13.3. Coverage, internet speed and connection quality may vary. The Seller undertakes to make every effort to provide the Services at all times, except during maintenance and repair. Services may be unavailable due to factors beyond the Seller's control, including emergencies, network problems or restrictions, interference, signal interruption and failures of other services.
13.4. Connection unavailability caused by third-party actions or restrictions, including allowlist policies in Russia, DPI or provider blocks, corporate restrictions, traffic filtering and other technical or administrative restrictions, is excluded from the 98% availability calculation and does not qualify for compensation.
13.5. The Services are provided to protect the User's privacy and secure their internet connection. The User must use the Services in accordance with the laws of the country in which they are located and is solely responsible for how they use them.
14. Changes to the Agreement
14.1. The Company may unilaterally change the terms of this Agreement by publishing a new version in the service available through the Telegram bot @gemera_vpn_bot.
14.2. Continued use of the service after changes are made constitutes the User's agreement to those changes.
